Terms and Conditions

Welcome to drop. drop helps people turn the plans they'd make into real nights out: post a plan, see who's in, go to events, and meet people in person.

These Terms are an agreement between you and drop, operated by a sole proprietor based in California, United States ("drop", "we", "us"). They cover the drop iOS app, the website at ondrop.rsvp, and the drop text number (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use drop.

Who can use drop

You must be 18 or older to use drop. By using it, you confirm that you are 18 or older, that the information you give us is accurate, and that you aren't barred from using the Service under the law. You can't use drop if we've previously banned you.

Your account

Your account is tied to your phone number, and you sign in with a code we text you. You're responsible for everything that happens on your account, so keep your phone and its codes to yourself. One account per person, and it has to be you: no accounts for someone else and no shared accounts. If you lose your number or think someone else is using your account, email us right away.

Your content

You own what you post on drop: your profile, photos, plans, events, messages and everything else you share ("your content").

To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt (for example, resize a photo) and share your content with the people you've chosen to share it with. We use this license only to operate, improve and promote drop, and it ends when you delete the content or your account, except for copies other people have already received or that we must keep by law.

You're responsible for your content and promise you have the right to post it.

Zero tolerance for objectionable content and abuse

drop is for meeting people in real life, so it only works if people feel safe. We have zero tolerance for objectionable content and abusive users. You may not post, send or do any of the following:

• Harass, bully, stalk or intimidate anyone.
• Post hate speech, or attack people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability or any other protected trait.
• Threaten violence or encourage anyone to harm themselves or others.
• Post or share any sexual content involving minors. We report this to the authorities.
• Post nudity, pornography or sexually explicit content.
• Send spam, scams, chain messages or unwanted promotions.
• Impersonate another person or misrepresent who you are.
• Promote or take part in anything illegal.
• Share someone else's private information, such as their phone number, address or photos, without their permission (doxxing).
• Try to break, scrape, reverse engineer or overload the Service, or get around a block or ban.

Reporting and blocking

You can report a person or content from inside the app, and you can block anyone. Blocking stops that person from contacting you on drop.

We review every report and act on it within 24 hours. If content or behavior breaks these rules, we remove the content and eject the user who posted it, which can mean suspending or permanently banning their account. We may also remove content or accounts on our own when we see a violation, with or without a report, and we may share information with law enforcement when someone's safety is at risk.

Meeting people in person

drop connects you with people you may not know yet, and much of what happens on drop happens offline. Please use good judgment:

• drop does not run background checks on users or verify who they say they are.
• Meet new people in public places, tell a friend where you're going, and leave if something feels off.
• You are responsible for your own interactions with other users, online and in person.
• Events are organized by their hosts, not by drop. drop isn't responsible for what happens at an event, the venue, or the conduct of hosts or guests.

If someone makes you feel unsafe, report them in the app. If you're in danger, call 911 or your local emergency number first.

Paid events

Some hosts sell tickets through drop. Payments are processed by Stripe, and the host is the seller: drop is not the organizer of the event. Refunds follow the host's refund policy and the refund cutoff shown for that event. Hosts who sell tickets must also accept Stripe's terms, and are responsible for their events, their refund policy, and any taxes they owe.

Text messages

By giving us your phone number, you agree to receive text messages from drop about your account, sign-in codes, plans, events, invites and messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, and reply HELP for help. Carriers are not liable for delayed or undelivered messages.

Ending your use of drop

You can stop using drop at any time, and you can delete your account in the app under Settings > Delete account. Our Privacy Policy explains what happens to your data when you do.

We may suspend or end your access to drop at any time if you break these Terms, if we're required to by law, or to protect other users. Sections that by their nature should survive (such as your content license for copies already shared, disclaimers, limits on liability and governing law) survive after your account ends.

Other sites and services

drop may link to or show content from other websites and services, such as Instagram or event pages you import. We don't control them and aren't responsible for them. Their own terms and privacy policies apply.

Disclaimers

drop is provided "as is" and "as available". To the fullest extent allowed by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that drop will be uninterrupted or error-free, that any plan will happen, or that any recommendation or match will be right for you. We aren't responsible for the conduct of any user, host or guest, online or offline.

Limitation of liability

To the fullest extent allowed by law, drop will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Service or your interactions with other users. Our total liability for any claim related to the Service is limited to the greater of the amount you paid drop in the 12 months before the claim or $100. Some places don't allow these limits, so they may not apply to you.

You agree to indemnify drop against claims arising from your content, your use of the Service, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in California, and you and drop agree to the jurisdiction of those courts. If any part of these Terms can't be enforced, the rest still applies.

Apple

These Terms are between you and drop, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is a third-party beneficiary of these Terms with the right to enforce them against you.

Changes to these Terms

We may update these Terms from time to time. We'll change the date at the top, and if the change is significant we'll let you know in the app or by text before it takes effect. If you keep using drop after that, you accept the new Terms.
